Once your OPT application is submitted, you may have up to 30 calendar days to travel to the United States to submit your I-765. You can read about specific OPT travel requirements and the USCIS application in U.S. CITIZENSHIP INFORMATION on the USCIS Website. If you are a non-native citizen of a visa waiver country: you cannot obtain a visa waiver if the application was mailed outside of U.S. territory (unless you are returning to a U.S. port of entry, and certain employment-related activities are not deemed a “visit” for these purposes). USCIS I-765 will not be considered pending travel plans. If you send your I-765 application while in the U.S., note that although your application is pending in order to expedite the process, you must prove that you will be leaving the United States by the time your application is due, i.e. that you will be able to return by the date your I-765 is due. If you mail your application earlier than your I-485 approval, you can later submit it in person, and you will be allowed to return to the U.S. to complete the I-485.

Between the submission of your application for OPT and the time you intend to travel to the United States, you are allowed to work in the U.S. on a student or F-1 work visa. Students may work up to 20 hours per week (up to 20 hours per work period).

When completed, you must reapply for F-1 status, with no authorization to remain in the U.S. If hired by the prospective employer, you may be authorized to remain in the U.S. You will need to obtain a replacement Form I-20 from your school that reflects your status as F-1 since your I-20 and remaining OPT period will have been forfeited. d2c66b5586
